Welcome to In Memorial! These terms and conditions outline the rules and regulations for the use of our graphic design and video services.

By accessing this website and/or engaging our services, you accept these terms and conditions in full. Do not continue to use In Memorial's services if you do not accept all of the terms and conditions stated on this page.
1. Scope of Services
1.1. In Memorial provides graphic design and video creation services including but not limited to digital design, print design, photo editing, and video editing.
1.2. Specific details of the services provided will be agreed upon with the client in writing (via email or contract).

2. Payment Terms
2.1. Payment is due upon agreement of the project scope and before commencement of work, unless otherwise agreed in writing.
For online purchases: Payment is due upon checkout.
For custom designs or services: Invoices will be issued electronically and must be paid within 7 days from the date of issuance unless otherwise agreed upon in writing. Payment is due in full before final file(s) are delivered.
For print requests: Payment is due in full before file(s) will be submitted to print servicer.
2.2. Payment methods accepted include our website's payment processor or PayPal. Payments can be made using most credit/ debit cards. No checks accepted.
2.3. By using our payment processing services, you agree to comply with the terms and conditions of our chosen payment processors.
2.4. Late payment may result in a delay in project delivery. In Memorial reserves the right to withhold delivery of completed work until full payment is received.
2.5 All transactions are processed in USD. Foreign currency exchange rates may apply if paying with a non-native currency, and any related fees will be the responsibility of the client.

3. Project Delivery
3.1. Project timelines and delivery dates will be agreed upon with the client in writing. In Memorial will make every effort to deliver projects on time, but delays may occur due to unforeseen circumstances or client-requested changes.
3.2. Delivery method of digital files depends on the product or service being purchased.
For DIY templates:
After successfully completing the purchase of a DIY template, client will receive an automated email that contains further instructions on how to access their template.

For templates or other design requests that will be assembled by In Memorial and/ or printed by client:
After payment has been made in full, final print ready file(s) will be delivered to client via email. If file(s) size is too large to be sent via email, a link to a cloud storage folder will be supplied via email in which the file(s) can be downloaded by client.

Physical deliverables (e.g., printed materials):
If client is fulfilling their printing request through In Memorial, they will select a shipping choice and speed at checkout or via contract. Items will be shipped to the client at the client's expense unless otherwise specified.

4. Revisions and Changes
4.1. The client has the right to request revisions to the work within the scope agreed upon. Additional charges may apply for revisions or changes that fall outside the agreed scope of work.
4.2. Major changes to the project brief or scope may incur additional fees and extend project timelines. These changes will be communicated and agreed upon with the client in writing before implementation.

5. Ownership and Usage Rights
5.1. Upon full payment, In Memorial grants the client rights to use the final deliverables (e.g., graphics, designs) for the purposes outlined in the project brief.
5.2. In Memorial retains the right to use the work created for promotional purposes, unless otherwise agreed with the client.

6. Confidentiality
6.1. In Memorial agrees to keep all client information and project details confidential unless required to disclose by law.

7. Security
7.1. In Memorial employs industry-standard security measures to protect your payment information. However, we cannot guarantee the security of information transmitted over the internet or stored electronically.
7.2. And payment or personal information submitted by client via our website or invoicing process will not be purposefully sold or shared by In Memorial to any outside parties.
7.3. Subscription to site contents such as newsletters, blogs, members areas, etc are strictly voluntary on behalf of the client. If client enrolls in such content and later has issues removing themselves from such services, they are to contact In Memorial via phone or email to obtain assistance with removal.
7.4. Any contact information provided by client will not be used for marketing purposes outside of voluntary serves that the client has enrolled in, see 7.3 above.

8. Liability
8.1. In Memorial will not be liable for any indirect, special, or consequential damages arising out of or in connection with the services provided.

9. Termination
9.1. Either party may terminate the agreement if the other party breaches any material term of these terms and conditions and fails to remedy the breach within 30 days of receiving notice.

10. Refunds
10.1. Due to the digital nature of our products and services, no refunds will be provided for digital works or services. Should an issue arise with delivery and receipt of printed materials, client is responsible for contacting In Memorial within 30 days of the product's shipped date to obtain a resolution.
10.2. Disputes regarding payments or charges must be reported to In Memorial within 5 days of the transaction date. Failure to report a dispute within this timeframe may waive the client's right to contest the charge.

11. Governing Law
11.1. These terms and conditions are governed by and construed in accordance with the laws of Colorado.

12. Changes to Terms
12.1. In Memorial reserves the right to modify these terms and conditions at any time. Changes will be effective immediately upon posting on our website.
